Introduction
These Terms govern access to and use of applicable services provided by Lux. Applying for, enrolling in or using a service may create a contractual relationship subject to these Terms, relevant enrolment information, agreed payment terms, program-specific conditions, the Privacy Policy and the Code of Conduct.
Browsing our public website alone does not create a tuition or enrolment contract.
About Lux
LuxDevHQ Services Limited (“Lux”) is a technology education and professional-development organisation located at D18A Garden Court, Garden Estate, Nairobi, Kenya.
Eligibility
You must provide accurate, current information relevant to an application or service. Where a service involves a minor, appropriate parent or guardian involvement, permission or contracting arrangements may be required according to the service and applicable law.
Applications and Enrolment
An application does not guarantee admission. Lux may communicate entry or enrolment requirements, and places may be subject to capacity. Applicants and students are responsible for keeping material information accurate and completing applicable enrolment steps.
Programs and Curriculum
Programs may include instructor-led sessions, practical exercises, assignments, projects, workshops, mentorship, presentations, internships or internal practical experience, and career-support activities.
Class Scheduling
Schedules are communicated through official Lux channels. Changes may occasionally be required because of instructor availability, technical issues, public emergencies or operational circumstances. Where appropriate, Lux may reschedule, provide a replacement session or offer another reasonable learning arrangement. Continuous, uninterrupted availability is not guaranteed.
Online and Physical Learning
Programs may be online, physical, hybrid, supported by recorded resources, or delivered through external learning and collaboration tools. Unless Lux expressly says otherwise, students are responsible for reasonable access to compatible devices, internet connectivity and required software.
Accounts and Access
Where Lux provides an account or platform access, protect credentials, do not share passwords, notify Lux of suspected compromise, and use the account only for authorised purposes. Lux may reasonably restrict access for security, misuse, account compromise, a material violation, or unpaid paid services where the agreed arrangement permits it.
Fees and Payments
Program fees, instalment amounts and deadlines are communicated before or during enrolment through the applicable offer or agreement. Students must pay according to agreed terms. Lux or its payment providers may create invoices, receipts and transaction references. Current course fees are maintained in the relevant program and enrolment information rather than these Terms.
Late or Outstanding Payments
If an agreed payment is overdue, Lux may issue reminders, discuss a payment arrangement, or temporarily restrict access to the affected paid service where the enrolment arrangement permits. Actions will be reasonable and proportionate; late payment alone does not mean educational records will be erased.
Refunds, Cancellations and Deferments
Refund, cancellation and deferment rights depend on the written rules communicated during enrolment, any program-specific terms, an approved deferment arrangement and applicable consumer law. Where Lux provides a specific written refund, cancellation or deferment policy, it forms part of the relevant enrolment terms.
Learning Materials
Lux may provide notes, slides, recordings, datasets, exercises, code examples, project briefs, templates and other learning resources. Unless stated otherwise, Lux-created materials remain owned by Lux or the relevant licensor and may be used for legitimate personal learning. Separate licences or notices take priority.
Student-Created Work and Intellectual Property
Students normally retain rights in their original work. This may differ where another agreement applies, the work incorporates Lux-owned or third-party materials, or it is created under a specific internship, employer or client agreement. Lux does not claim ownership of every student repository.
Lux may ask permission to showcase student work. Voluntary publication is also subject to the relevant platform's terms; promotional use is not automatic, unlimited ownership.
Open Source and Third-Party Software
Courses may use open-source software, APIs, cloud services, GitHub, external datasets and third-party development tools. Separate licences and service terms may apply. Students must comply with relevant licences and restrictions when publishing or deploying work.
API Keys, Credentials and Secrets
Never publish passwords, API keys, private tokens, database credentials, SSH keys, cloud secrets or personal information in assignments, screenshots, Git repositories or technical articles. Remove secrets from code and rotate any credential that may have been exposed.
Acceptable Use
Do not use Lux services for illegal activity, malicious hacking, unauthorised access, harassment, spam, malware distribution, intentional disruption or infringement of third-party rights. Security exercises are permitted only within expressly authorised environments and boundaries.
AI Tools
Lux may permit responsible AI use under the Code of Conduct and assignment-specific instructions. Third-party AI availability, terms and privacy practices may change. Students remain responsible for the work they submit.
Recordings
Some classes or activities may be recorded. Personal-data processing is addressed in the Privacy Policy. Students must not redistribute private class recordings without authorisation.
Career Support
Certificates
Where Lux issues certificates, eligibility may depend on applicable completion requirements communicated for the program. Lux may correct administrative errors, incorrectly issued certificates and fraudulent certificates.
Community and Events
Workshops, events and community activities may include reasonable venue rules, safety requirements and event-specific conditions communicated to participants.
Third-Party Services
Lux uses third-party systems where appropriate for payments, communication, hosting, video conferencing, learning, source control and cloud services. Their terms and privacy policies may also apply. Current website analytics are described in the Cookie Policy.
Service Availability
Lux aims to provide reliable services but websites, third-party platforms, online classes and internet services may occasionally be interrupted, unavailable or changed. Lux will take reasonable steps within its control to address material service issues.
Disclaimer Regarding Technical Content
Technical examples are educational and may require adjustment for different software versions, operating systems, APIs, libraries or cloud services. Participants should test work, review current documentation and apply appropriate professional judgment before production use.
Limitation of Liability
To the extent permitted by applicable law, Lux is not responsible for indirect losses arising solely from external-service outages, third-party platforms, unauthorised user misuse, or employment decisions by independent employers. Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.
Privacy
How Lux handles personal information is described in the Privacy Policy, with website technologies further explained in the Cookie Policy.
Code of Conduct
Participation in Lux learning, community, event and premises activities is subject, where applicable, to the Code of Conduct.
Suspension or Termination
Lux may suspend or terminate affected access for serious non-payment where applicable, security abuse, misconduct, fraud or a material breach. Where reasonably possible, action will be proportionate to the circumstances and relevant agreements.
Changes to These Terms
Lux may update these Terms to reflect changes in services, law or operations. Material changes affecting an existing contractual relationship should be communicated appropriately. A change does not become binding for every purpose merely because someone once visited the website.
Governing Law
These Terms are governed by the laws of Kenya. Nothing here prevents either party from using rights or remedies available under applicable law.
